The European Commission has embarked on the revision of the current block exemption regulation on technology transfer agreements (Ttber) and related antitrust guidelines. The review process happens amidst an historical moment of uncertainty and of intense and multiple transitions, that could be hindered or fostered by a more favorable environment for disruptive technologies. Consultations by the European Commission and experts’ contributions are paving the way for a new version of the Ttber that does not envision significant changes and adopts a more incremental approach, that is seen as more instrumental to ensure certainty for market players, as opposed to a more radical option. This article discusses the review process and considers topics that might become part of the debate, particularly as far as sustainability goals that parties envision in technology transfer arrangements, in the framework of what is now known as the green antitrust.
