This paper undertakes a preliminary examination of legislative intent as reflected in the most recent legislative initiatives in the field of Building and Planning Law in Italy. The aim is to compare the findings of this inquiry with the manner in which the Council of State has relied on legislative intent as an interpretative tool in the same field, with particular emphasis on changes in the designated use of buildings. The analysis also seeks to shed light on the role of the Administrative Judge within the context of ongoing reform processes.
