Abstract

The analysis offered by Scamardella in her recent book "Etsi consitutio non daretur. Civil Constitutions in the Transnational World" intercepts fundamental nodes of the articulated and polyphonic contemporary reflection on legal globalization, taking them under examination from the peculiar perspective of the Teubnerian theory of social constitutionalism. In dialogue with such perspective, the following notes are intended to share some food for thought, particularly on the issues of global legal pluralism – in its relation to interlegality – and the protection of fundamental rights.
