The article aims to show the shortcomings found in the European and national legislations related to the procedure for the recognition of the international protection where it is evident a restriction of the "right to be heard" of the asylum seeker, as no norm forces States to provide him/her with legal aid. This gap has serious consequences and for these reasons the work of those who provide free legal advice to asylum seekers is invaluable: among these, the University of Brescia with the Aslym and Immigration Clinic course.
