The issues of “regulatory sustainability” have been a long-standing part of the strategies of European Union institutions, in the belief that poor regulation has a negative impact not only on legal certainty, compliance with the law and efficiency of justice, but also on a country’s economic development and resource efficiency. In recent years, the European Commission has considered to focus further attention on the “better regulation”, on the assumption that the current social/economic situation requires a legislation that is even more effective and efficient in achieving its general interest objectives. In this perspective, every regulatory act must not only be drafted in a simple, clear and univocal way in language and meaning, but at the same time it must be taken on the basis of a full awareness of the possible effects it will produce not only in the legal system, but also and above all on its recipients, citizens and businesses, and on public administration. In this paper, we will briefly reconstruct the principles and cornerstones of European “better regulation” with a look at the current regulatory sustainability scenario.
