Legal Polycentricity, intergiuridicità e dimensioni “intersistemiche” dell’interpretazione giudiziale. Riflessioni a partire dal caso inglese Akhter v. Khan

The paper aims to point out the inter-systemic character of judicial interpretation in contexts of legal polycentricity and interlegality, focusing on the interaction between domestic law, international fundamental rights law, and minority legal orders. Through the paradigmatic case Akther v. Khan, it shows, on the one hand, how international fundamental rights law can lead national judges to take into account minority legal orders; on the other, how this attitude of national judges can, in turn, push for the attribution of new, unexpected and sometimes controversial meanings to both national and international legal sources.
