The recognition of social rights to foreigners is a fundamental condition for the success of the migrant integration policies within the national territory. The article will analyze the chronic migration emergency in the perspective of its impact on the Italian migration law in relation to the employment access rules, work conditions and welfare instruments for migrant workers, focusing on the effects on the principles mentioned above. The migratory emergency, in fact, is putting a strain on some fundamental principles of Italian legal system, that is the legality in relation to access and stay of migrants, the integration of foreign workers and safety at work and, finally, the equal treatment in the welfare.
