In Italy, administrative functions have received a new account by the constitutional reform in 2001. The new distinction among “fundamental”, “conferred”, “proper” and “assigned” functions, under article. 118, requires an examination of the meaning of these expressions. It’s also interesting to see how this distinction is applied in the context of the government of the territory, even in light of indications from European law. It’s a matter that affected, more than the others, the difficulties owed to the delays (existing in Italy) in the implementation of the constitutional reform at the administrative level.
