La specialità regionale nell'ordinamento italiano e in quello dell'Unione europea

Due to their particular characteristics and conditions, a few Regions are granted a special status, in the national as well as in the European Union juridical order. Regional speciality is normally guaranteed by means of two kind of measures aimed, on one side, to protect and value the peculiar regional characteristics and, on the other side, to avoid that this peculiarity becomes an handicap for the concerned Regions. The practice, however, shows that - even if with some differences - both in national and in European Union legal order, these measures are confused, overlapped and adopted in a very limited range of cases. Regional speciality is perceived as a pretext for a legal status of privilege in violation of the principle of equality, so that it is generally disregarded and also challenged. This situation evidences the necessity of rethinking regional speciality, verifying the causes and responsibilities of its decadence, in view of relaunching it and the territorial context to which these special Regions belong.
